Adoptive Parent

A person usually residing abroad can adopt a child, usually residing in Republic of Bulgaria, provided such citizen is entered in the register of adoptive parents, usually residing abroad and applying to adopt, under the conditions of full adoption, Bulgarian or foreign child usually residing in Republic of Bulgaria, maintained by The Ministry of Justice.

Person to Be Adopted

A child, usually residing in Republic of Bulgaria, can be adopted by foreign or Bulgarian citizen, usually residing abroad, provided possibilities for child's adoption in Bulgaria have been exhausted and the child is entered in the register of children, eligible to be adopted under the conditions of full adoption by persons usually residing abroad, maintained by The Ministry of Justice.

International Adoption Council Competence for determining suitable adoptive parent

International Adoption Council shall be established near the Ministry of Justice and shall consist of the following: Chairman - Deputy Minister of Ministry of Justice, and Members - one representative of the following: Ministry of Justice, Ministry of Health, Ministry of Education and Science, Ministry of Labor and Social Policy, Ministry of Foreign Affairs and Child Protection State Agency.

The International Adoption Council shall make proposal to the Minister of Justice for determining suitable adoptive parent.The Minister of Justice shall give consent for adoption of a child, usually residing in Republic of Bulgaria, by the adoptive parent proposed by the International Adoption Council.

International Adoption Council criteria for determining an appropriate adopter /adoptive parent

The Directorate for International Legal Protection of the Child and International Adoptions shall examine the children and the adopters about the opportunity to make adoption, shall prepare reports and shall present them to the Council for international adoptions about consideration and making decisions.

Within 60 days after the entry of the children in the register of children, eligible to be adopted under the conditions of full adoption by persons usually residing abroad, the Council for International Adoptions shall consider the applications to determine an appropriate adopter in compliance with the succession of entry of the adopters in the registers, their preferences, as well as the circumstances, which are in the interest of the child. The children's dossiers shall be considered by the Council according to the sequence of their entry and shall be compared with the data of the adopters and the conditions contained in the permits / the capability to adopt.

For the determination of an adopter, the Council shall consider all appropriate applications.

Upon making decision to determine an appropriate adopter in addition to the criteria under pg. 1, the Council will be also take into account the capabilities of the adopters to ensure the child’s physical, mental and social well-being, as well as information about the personality of the adopter and other circumstances, which are significant for the adoption. The assessment shall be made mainly on the basis of the reports about the adopters, prepared by the relevant competent authorities.

The decision shall contain data about the child and the adopters and short reasoning about the choice.
